Privacy Policy

At InMarkit, we know that your privacy is important to you. This Privacy Policy describes our privacy practices on the inmarkit.com website (the “Site”) and all related mobile components, software, and services that we provide (each a “Service” and, together with the Site, collectively the “Services”). This Privacy Policy is part of the Terms of Use that govern your use of the Services.

Because the Internet is global, information about you that we collect or that you submit may be transferred to, processed, and held in countries (including the United States) other than the one in which you live, where laws regarding processing of your personal information may be less stringent than the laws in your country. By using the Services, you explicitly consent to such use of your information and agree to the terms of this Privacy Policy.

We may change this Privacy Policy at any time. Such changes shall be effective immediately upon our posting the revised Privacy Policy on the Services. Please review the Site and this Privacy Policy periodically so that you are aware of any modifications. Your continued use of the Services after such modifications will constitute your acknowledgment of the modified Privacy Policy and agreement to abide by and be bound by the modified Privacy Policy.

1. Types of Information We Collect

Our primary goal in collecting information from you is to provide you with a smooth, efficient, and customized experience while using our Services. We collect two types of information about our users: Personally Identifiable Information and Non-Personally Identifiable Information.

Personally Identifiable Information is information that lets us know the specifics of who you are, such as your first and last name, mailing address (including zip code), email address, telephone and facsimile numbers, credit card numbers, and other personal identifying information.

Non-Personally Identifiable Information is information that does not, by itself, identify a specific individual, such as the Uniform Resource Locator (“URL”) of the website that you were using before coming to our Services, which URL you go to next, what browser or mobile device you are using to access the Services, and your Internet Protocol (“IP”) address.

2. How We Collect and Use Information

We do not collect any Personally Identifiable Information about you except when you voluntarily provide it to us, whether you provide it to us directly or you authorize us to access Personally Identifiable Information you may have provided to third parties with whom we have an arrangement that permits us to integrate their service offerings with our own (our “Service Partners”). For example, you may authorize us to access your Personally Identifiable Information stored in your account with a Service Partner such as a retailer or a social networking site. When you use particular aspects of the Services, such as registering for a membership, ordering a product or service, signing up for special offers, submitting content and/or posting content in public areas, entering a contest or sweepstakes, filling out a survey, or sending us feedback, we may ask you to provide Personally Identifiable Information. We may also collect Personally Identifiable Information from you at other points in our Services that state that such information is being collected. You are free to choose whether or not to provide the requested information. However, you may not be able to use all of our Services if you do not provide the requested Personally Identifiable Information.

We use your Personally Identifiable Information to provide the Services to you. For example, when you register for the Services we will use the mobile phone number and email address you provide to validate your registration. We will also use Personally Identifiable Information to enhance the operation of the Services, improve our marketing and promotional efforts, statistically analyze Site use, and customize the content, layout, and features of the Services. For example, we use your Personally Identifiable Information to recommend products and services that you may be interested in based upon your previous history of using our Services. We will use Personally Identifiable Information to deliver information to you and to contact you. We also use Personally Identifiable Information to resolve disputes, troubleshoot problems and enforce our agreements with you, including our Terms of Use and this Privacy Policy.

Our Services automatically collect Non-Personally Identifiable Information based upon your use of the Services. We compile and analyze Non-Personally Identifiable Information on both a personal and an aggregated basis and use such information to enhance the operation of the Services. For example, we collect and use your IP address to diagnose problems with our systems and to gather demographic information. Our third party ad servers will also provide us with summary, but not individual, reports that will tell us how many ads were presented and clicked upon.

3. How We Share Your Information

    (a)    Generally. Except as otherwise described in this section of our Privacy Policy, we will not share your Personally Identifiable Information or Non-Personally Identifiable Information with any third party without your permission.

    (b)    Retail Partners. If you affirmatively authorize us to do so, from time to time we may share your Personally Identifiable Information with our retail partners so they may contact you regarding goods or services in which you may be interested. We offer you the opportunity to control whether we do so, both at the time you register for the Services or at any time thereafter by accessing and editing your profile page. If you previously have authorized us to share your Personal Information with our retail partners for their direct marketing purposes, and thereafter request that we not do so by accessing and editing your profile page, please note that sometimes these requests may take up to thirty days to process. Also, please note that any information or authorizations you have provided independently to any of our retail partners will not be impacted by any such request. We are not responsible for removing information about you from the database of any third party to whom we were authorized to disclose your Personally Identifiable Information prior to processing your request.

    (c)    Service Providers. From time to time, we may enter into relationships with third parties who provide services to us (e.g., data management and storage services or credit card processing services). In those circumstances, we disclose Personally Identifiable Information that is necessary for such service providers to perform those services.

    (d)    Your Profile. The Services enable you to create a profile, include information about yourself in your profile and identify whether you would like us to contact you via email, your mobile phone or both. If you send a message through the Services to another user, we will disclose your user name to the recipient.

    (e)    Non-Personally Identifiable Information. We may provide Non-Personally Identifiable Information about our customers (such as sales and traffic patterns), as well as aggregated information based on Personally Identifiable Information (such as aggregated geographical information, but not in manner that would enable the recipient to personally identify you) to our retail partners. Please note that if you independently have provided any Personally Identifiable Information to any of our retail partners, they may associate the information we provide to them about your use of the Services with that Personally Identifiable Information.

    (f)    Other Disclosure Scenarios. We may be required by law enforcement or judicial authorities to provide Personally Identifiable Information to governmental authorities. We fully cooperate with law enforcement agencies in identifying those who use our Services for illegal activities. We will disclose Personally Identifiable Information upon receipt of a court order or subpoena, or to cooperate with a law enforcement investigation. We may use your Personally Identifiable Information to report to law enforcement agencies any activities that we believe to be unlawful. We may provide your Personally Identifiable Information to our parent company, subsidiaries, joint ventures, or other companies under common control with us (in which case we will require such entities to honor this Privacy Policy) and if we are acquired by or merged with another entity.

4. Security of Your Information


We take commercially reasonable precautions to secure your Personally Identifiable Information consistent with current industry standards. You can access the Personally Identifiable Information in your account through your password and unique customer ID. Do not share your password with anyone.

No data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. While we strive to protect your Personally Identifiable Information, there are security and privacy limitations of the Internet which are beyond our control. Therefore, the security, integrity and privacy of any and all information and data exchanged between you and us through the Services cannot be guaranteed, and any such information and data may be viewed or tampered with in transit by a third party. We assume no responsibility for the security of your data that we may transmit to third parties once that data is in their possession.

5. Cookies

When you use the Services, we will store cookies on your computer and/or mobile device in order to facilitate and customize your use of our Services. A cookie is a small data text file stored on your mobile device and/or computer hard drives that the Services can retrieve to identify you to us. Our cookies store randomly assigned user identification numbers, the country where you are located, and your name. Cookies make your use of the Services easier, make the Services run more smoothly and help us to maintain the security of the Services. You may decline our cookies if your browser permits, but if you do so, some parts of the Services may not work properly.
We may use an outside ad serving company to display banner advertisements on the Services. As part of their service, they may place a separate cookie on your computer and/or mobile device.

6. Third Party Services and Sites

This Privacy Policy only governs the collection, use and disclosure of information by us through our Services. Our Service Partners, and other services and web sites accessible through or from the Services, have their own privacy policies and data collection, use and disclosure practices. We are not responsible for the policies or practices of third parties, including our Service Partners. Our Service Partners and other companies which place advertising or other content on the Services may collect information about you when you view or click on their advertising or content. We do not control this collection of information. You should contact these third parties directly if you have any questions about their use of the information that they collect.

7. Modifying and Deleting Your Information

If you would like to modify or delete from our database any Personally Identifiable Information you previously submitted to us, please let us know by accessing and updating your profile. Please note that any information that we have copied may remain in back-up storage for some period of time after your request, and that if you delete certain information you may not be able to use the Services (or portions thereof) in the future without re-submitting such information. Also, please note that we will maintain your information in our database whenever we are required to do so by law.

8. Children


You must be at least 13 years old to use the Services. We do not knowingly collect personally identifiable information from children under the age of 13.

9. Miscellaneous


If you disclose your Personally Identifiable Information in public areas on the Services, that information, along with any information disclosed in your communication, can be collected and used by third parties and may result in unsolicited messages from third parties. Such activities are beyond our control and this Privacy Policy does not apply to such information. If you submit any information to public areas on the Services, you do so with the understanding that such information is accessible to all third parties. If you do not want such information to be viewed by third parties, do not share it in public areas.
